2013 Legislation: AB 126

This bill requires a time-share association to maintain a complete list of the names and postal addresses of all owners of time-share interests in the time-share plan and to update the list at least every 12 months.

§4255 - Airport Influence Areas

  1. If a common interest development is located within an airport influence area, a declaration, recorded after January 1, 2004, shall contain the following statement:


§4202 - Commercial and Industrial Developments

  1. The following provisions do not apply to a common interest development that is limited to industrial or commercial uses by zoning or by a declaration of covenants, conditions, and restrictions that has been recorded in the official records of each county in which the common interest development is located:
    1. Section 4275.

§4200 - Common Interest Developments

This act applies and a common interest development is created whenever a separate interest coupled with an interest in the common area or membership in the association is, or has been, conveyed, provided all of the following are recorded:

  1. A declaration.
  2. A condominium plan, if any exists.
  3. A final map or parcel map, if Division 2 (commencing with Section 66410) of Title 7 of the Government Code requires the recording of either a final map or parcel map for the common interest development.

§4158 - Managing Agent

  1. A "managing agent" is a person who, for compensation or in expectation of compensation, exercises control over the assets of a common interest development.
  2. A "managing agent" does not include any of the following:
    1. A regulated financial institution operating within the normal course of its regulated business practice.
    2. An attorney at law acting within the scope of the attorney's license.

§4110 - Community Service Organization

  1. "Community service organization or similar entity" means a nonprofit entity, other than an association, that is organized to provide services to residents of the common interest development or to the public in addition to the residents, to the extent community common area or facilities are available to the public.

§4105 - Community Apartment Project

"Community apartment project" means a development in which an undivided interest in land is coupled with the right of exclusive occupancy of any apartment located thereon.

§4100 - Common Interest Development

"Common interest development" (CID) means any of the following:

  1. A community apartment project.
  2. A condominium project.
  3. A planned development.
  4. A stock cooperative.

§11501 - Common Interest Development Manager

  1. "Common interest development manager" means an individual who for compensation, or in expectation of compensation, provides or contracts to provide management or financial services, or represents himself or herself to act in the capacity of providing management or financial services to an association. Notwithstanding any other provision of law, an individual may not be required to obtain a real estate or broker's license in order to perform the services of a common interest development manager to an association.
