2015 Legislation - SB 419 - Mobile Home "For Sale" Signs

SB 419 would permit the use of yard-arm style “for sale” signs in mobile home parks, some of which are homeowners associations.

§4730 - Marketing of Units

  1. Any provision of a governing document that arbitrarily or unreasonably restricts an owner's ability to market the owner's interest in a common interest development is void.
  2. No association may adopt, enforce, or otherwise impose any governing document that does either of the following:

§4710 - Display of Noncommercial Signs

  1. The governing documents may not prohibit posting or displaying of noncommercial signs, posters, flags, or banners on or in a member's separate interest, except as required for the protection of public health or safety or if the posting or display would violate a local, state, or federal law.

§1353.6 - Displaying Noncommercial Signs, Posters, Flags and Banners

  1. The governing documents, including the operating rules, may not prohibit posting or displaying of noncommercial signs, posters, flags, or banners on or in an owner's separate interest, except as required for the protection of public health or safety or if the posting or display would violate a local, state, or federal law.

§713 - Local Regulations: Signs for Property Sale, Lease or Exchange

(a) Notwithstanding any provision of any ordinance, an owner of real property or his or her agent may display or have displayed on the owner's real property, and on real property owned by others with their consent, signs which are reasonably located, in plain view of the public, are of reasonable dimensions and design, and do not adversely affect public safety, including traffic safety, as determined by the city, county, or city and county, advertising the following:
